Terms of Service

Please read these Terms of Service ("Terms") carefully before using Designer in an Instant. By creating an account, booking a session, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Nature of the Service
Designer in an Instant ("DII," "we," "us," or "our") operates an online platform that connects clients with independent, third-party interior designers for live and photo-based design consultations. DII is a technology platform and scheduling/communications service — DII does not itself provide interior design services, does not design, build, install, renovate, or contract any physical work, and is not a party to the design relationship between a client and a designer.
2. Advice Provided Is Limited to Interior Design
Sessions booked through DII are intended for general interior design guidance only — for example, space planning, furniture selection, color and material choices, layout, and styling. DII does NOT offer, and no designer on this platform is authorized by DII to offer, electrical, HVAC (heating, ventilation, and air conditioning), plumbing, structural, or general contracting advice. Any comment made during a session that touches on these areas is offered, if at all, as general, non-binding, aesthetic-level observation only and must not be relied upon for any safety-related, code-related, load-bearing, mechanical, or system-related decision. You must consult a licensed electrician, plumber, HVAC technician, structural engineer, architect, or general contractor, as applicable, before making any decision or taking any action involving electrical, plumbing, HVAC, or structural work.
3. Advisory Only — No Guarantees
All recommendations, ideas, and guidance provided through DII sessions are professional opinions based on the information, photos, and preferences you provide, and are inherently subjective. We do not guarantee that you will like, agree with, or be satisfied with any recommendation, that any recommendation is free of error, or that following a recommendation will produce any particular result, outcome, cost, or aesthetic. Design is a matter of personal taste, and disagreement with or dissatisfaction with a recommendation is not a defect in the Service and is not grounds for a refund, credit, or claim against DII.
4. Independent Designers
Designers who provide sessions through DII are independent professionals, not employees or agents of DII. DII does not control, direct, or supervise the specific advice a designer gives during a session, and is not responsible or liable for the accuracy, completeness, or quality of any individual designer's advice, credentials, licensing status, or professional conduct. Any dispute regarding the substance of advice given during a session is between you and the designer.
5. Your Responsibility
You are solely responsible for all decisions and actions you take based on a DII session, including but not limited to purchases, renovations, do-it-yourself work, and the hiring or direction of contractors or other professionals. Before undertaking any work in your home — especially anything involving electrical, plumbing, HVAC, structural, or other safety-related systems — you are responsible for obtaining advice from, and where required by law, permits and inspections from, appropriately licensed professionals.
6. No Warranties
THE SERVICE AND ALL SESSION CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. DII DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DESIGNER RECOMMENDATION WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC PROJECT.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DII AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATED DESIGNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROPERTY VALUE, PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY SESSION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, DII'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO DII FOR THE SESSION(S) GIVING RISE TO THE CLAIM.
8. Assumption of Risk
You acknowledge that home design, renovation, and DIY projects carry inherent risks, and that you voluntarily assume those risks when you act on guidance received through the Service, whether you perform the work yourself or hire a third party to perform it.
9. Indemnification
You agree to defend, indemnify, and hold harmless DII and its officers, employees, contractors, and affiliated designers from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or any decision or action you take based on a session.
10. Payment, Cancellation, and Refunds
Session fees are due at the time of booking. You may cancel or reschedule a session free of charge up to 24 hours before the scheduled start time; cancellations made less than 24 hours before the session, and missed sessions, may forfeit the session fee. Once a session has been delivered, DII does not offer refunds, credits, or partial refunds on the basis that you were dissatisfied with, disagreed with, or chose not to follow the designer's advice or recommendations. Design guidance is inherently a matter of professional opinion and personal taste, and receiving advice you did not like is not a service failure. This no-refund policy applies regardless of the reason for your dissatisfaction with the substance of the advice given.
11. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. You agree to provide accurate information and are responsible for maintaining the confidentiality of your account credentials.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles, and any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina, unless otherwise required by applicable law.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date below. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
